The Eighth Amendment to the U.S. Constitution prohibits executing intellectually disabled people. Similarly, Ernest’s lawyer, Jeremy Weis, has stated that executing Ernest will violate the aforementioned amendment.
According to Jeremy, Ernest was born with fetal alcohol syndrome. In fact, in 2008, while a benign tumor was being removed, Ernest also lost about one-fifth of his brain tissue.
Jeremy asked for a stay of execution to the U.S. Supreme Court on Monday.

Unfortunately, Missouri Gov. Mike Parson declined to grant Clemency to Ernest Johnson.
